Head of Commercial and Contract Services

The Opportunity

Lead Commercial Strategy. Strengthen Contractual Outcomes. Manage Risk.

We are seeking an experienced Head of Commercial and Contract Services to join our senior leadership team in Brisbane, providing strategic and practical advice across the organisation’s commercial, contractual, procurement, tendering and risk activities.

Reporting to the EGM – Operations, this is a senior commercial and contract-focused role responsible for protecting Trident’s commercial interests and strengthening contractual outcomes across the full contract lifecycle — from tender development and contract negotiation through to contract execution, performance, variations, renewals, claims, disputes and ongoing commercial management.

We are looking for someone who combines strong legal and contractual expertise with commercial judgement and understands how to translate complex contractual requirements and risks into practical business outcomes.

This is an opportunity for an experienced commercial or contracts professional to have significant influence across a growing Australian-owned organisation and work closely with senior executives, operational leaders, clients, suppliers and external advisers.

Key Responsibilities
Commercial & Contract Management

Provide senior-level commercial and contractual advice across Trident’s operations and business functions.

Lead the review, drafting, interpretation, negotiation and management of commercial agreements, including client contracts, supplier agreements, service agreements, confidentiality agreements, variations and other contractual arrangements.

Identify, assess and mitigate contractual, commercial and operational risks.

Ensure contractual terms align with Trident’s commercial objectives, operational capabilities and risk appetite.

Oversee the full contract lifecycle, from tender and negotiation through to execution, performance management, variations, renewals and close-out.

Provide guidance to operational and commercial teams on contractual obligations, rights, remedies, performance requirements and potential areas of exposure.

Provide advice on contractual claims, disputes, breaches, extensions, renewals and other commercial matters.

Support the resolution of contractual disputes and commercial issues, working with external legal advisers where appropriate.

Tendering & Business Growth

Provide commercial and contractual leadership across major tenders, proposals and new business opportunities.

Review tender documentation and identify key contractual, legal, commercial and financial risks.

Support the development of commercially sound tender submissions and pricing strategies.

Lead or support contract negotiations with prospective and existing clients.

Ensure commercial assumptions, exclusions, service requirements, liabilities and contractual obligations are clearly understood prior to contract award.

Support contract growth, extensions, renewals and variations to maximise sustainable commercial outcomes.

Contribute to business development initiatives by identifying commercial opportunities and supporting strategies for sustainable growth.

Commercial Governance, Risk & Compliance

Develop and maintain robust commercial and contract governance frameworks, policies, processes and standards.

Establish appropriate contract review, approval and escalation processes across the organisation.

Maintain oversight of key contractual risks, liabilities, indemnities, insurance requirements, warranties, termination provisions and other areas of commercial exposure.

Provide executive reporting and recommendations relating to commercial performance, contractual risk and emerging issues.

Ensure commercial and contractual practices align with relevant legislation, regulatory requirements, organisational policies and governance standards.

Stay informed of relevant legal, regulatory and industry developments and advise the business of potential commercial or contractual impacts.

Work closely with internal stakeholders and external advisers on complex legal, contractual and commercial matters.

Procurement & Supplier Management

Provide strategic oversight of procurement and supplier contracting activities.

Lead commercial negotiations with key suppliers and service providers.

Develop procurement strategies that deliver value, mitigate risk and support operational requirements.

Strengthen supplier contract management, performance monitoring and commercial reporting.

Ensure appropriate commercial evaluation, due diligence and approval processes are followed.

Support the development and implementation of consistent supplier and contract management practices across the organisation.

Leadership & Stakeholder Management

Lead and develop commercial, procurement, contract management and tendering capabilities across the organisation.

Partner with the Executive Leadership Team and operational leaders to provide practical and commercially focused advice.

Build strong relationships with clients, suppliers, professional advisers and other key stakeholders.

Develop commercial and contractual capability across the business through coaching, guidance and continuous improvement.

Promote a culture of commercial accountability, sound governance and proactive risk management.

About You

You are an experienced commercial or contracts professional with a strong legal and contractual background, extensive experience in commercial contracting and negotiation, and the ability to balance contractual risk with practical business outcomes.

You will bring:

8–10+ years’ experience in commercial contracts, contract management, commercial, procurement, tendering or related environments.

A strong background in commercial contract drafting, review, interpretation and negotiation.

Demonstrated experience managing complex contractual arrangements, commercial risks, claims and negotiations.

The ability to interpret complex contractual and legal issues and provide clear, commercially practical advice to senior stakeholders.

Experience across the full contract lifecycle, including tendering, drafting, negotiation, execution, variations, performance management and renewals.

Strong understanding of contractual and commercial risk, including liability, indemnities, insurance, warranties, termination provisions, obligations and remedies.

Experience working within complex, multi-site or operational environments, ideally within facilities services, security, infrastructure, technology, property, asset management or a related industry.

Strong commercial and financial acumen, with the ability to understand pricing, margins, budgets and broader business impacts.

Exceptional negotiation, influencing and stakeholder management skills.

Strong written and verbal communication skills, with the ability to communicate complex contractual and commercial matters clearly to non-legal stakeholders.

The ability to work autonomously, manage competing priorities and exercise sound commercial judgement in a fast-paced environment.

Qualifications
Essential

Tertiary qualification in Law, Business, Commerce, Accounting, Economics or a related discipline.

Significant demonstrated experience in commercial contracts, contract management, procurement, tendering or a related commercial function.

Highly Desirable

Law degree (LLB or equivalent) or demonstrated legal/contractual experience.

Background in commercial law, legal services, contract advisory or a related legal environment.

Admission as a solicitor in an Australian jurisdiction, where applicable.

Postgraduate qualification such as an MBA or relevant commercial, procurement or leadership qualification.

Professional certification in procurement, contract management or commercial management.
