These Terms of Service outline the rights and obligations of the user and the vendor in relation to the service, forming a legal agreement. By using Xprt on your device, either as a guest or a registered user, you agree to the terms in accordance with this document.

Definitions

For the purposes of these Terms of Service:

  • "We", "our" or "us" refers to 0x234 Pty Ltd, an Australian proprietary limited company.
  • "You" or "your" refers to the person or entity accessing or using the platform.
  • "Platform" refers to the website, content, application, and infrastructure specifically powering Xprt Jobs.
  • "Service" refers to general services offered by us or third-party providers, including functionalities or features made available through the platform or integrated third-party tools.
  • "User" refers to any person or entity accessing the platform, with or without an account.
  • "Job Seeker" refers to users who are searching for employment opportunities through the platform.
  • "Advertiser" refers to any entity posting job opportunities on the platform. This may include employers posting directly or recruiters acting on behalf of their clients.
  • "Employer" refers to the organisation or individual representing an organisation that is offering a job position and seeking candidates.
  • "Recruiter" refers to an individual or agency posting jobs on behalf of an employer.
  • "Account" refers to a unique account created for you to access the platform or parts of the platform.
  • "Device" refers to any electronic device that can access the platform, including but not limited to a computer, a cell/mobile phone or a tablet.
  • "Personal Data" refers to any information that relates to an identified or identifiable individual.
  • "Third-party social media service" refers to any website or any social network website through which a user can log in or create an account to use the platform.
  • "Usage data" refers to data collected automatically, either generated by the use of the platform or from the platform infrastructure itself (for example, the duration of a page visit).
  • "Job advertisement" or "Job listing" refers to a notice posted on the platform by an Advertiser that describes an employment opportunity, including but not limited to job title, description, requirements, location, compensation, and application instructions. These terms are used interchangeably throughout this document.

Eligibility Requirements

To use the platform and/or own an account, you agree to meet the following requirements:

  • You are legally permitted to work in your country of residence.
  • You will provide current and accurate information at all times.
  • You will maintain the security of your account.
  • You will use the platform solely for its intended purpose and refrain from any unauthorised or illegal activities.
  • You will comply with all applicable laws and regulations, including employment and anti-discrimination laws.
  • You will respect other users and refrain from harassment, abuse, or spamming.
  • You will not post false, misleading, or fraudulent information.

If you are an advertiser, then additionally:

  • You must have the legal authority to post job advertisements on behalf of your organisation.
  • You will only post legitimate job opportunities with complete and truthful details.
  • You will remove or update job postings that are no longer valid or relevant.

If you do not meet these requirements and/or any failure to do so may result in account termination as the platform is not for you.

Acceptable Use

When creating an account, it is imperative that your usage aligns with the guidelines and intended purposes set forth by the platform. The platform is designed to accommodate a variety of users, each with different needs and expectations.

You agree to use your account in a manner that is consistent with its intended purpose and in compliance with these Terms of Service. We reserve the right to review and monitor account activities to ensure compliance with our usage policies.

Should we determine that an account is being used inappropriately, or in a manner that is not consistent with its intended purpose or the terms outlined in this document, we reserve the right to take appropriate action, which may include suspending or discontinuing your account.

International Use

The platform is designed to cater to a global audience, and we welcome users from around the world. However, as our operations are based in Australia, the platform is governed by Australian laws and regulations.

If you access the platform from outside Australia, you do so on your own initiative and are responsible for complying with local laws regarding online conduct, content standards, and data privacy. This includes ensuring that your use of the platform is lawful in your jurisdiction, particularly in areas such as data sharing, content publishing, and employment-related activities.

Please be aware that the information you provide or the content you share on the platform is stored and processed in Australia, and by using our platform, you consent to this transfer, storage, and processing in accordance with Australian laws, which may differ from those in your country.

Intellectual Property

You represent and warrant that you are the creator and rightful owner of any content you provide on the platform and that such content does not infringe the intellectual property rights of any third party. All rights to the content remain solely with you, and we do not claim ownership or intellectual property rights over your content.

By providing content on the platform, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, store, and distribute your content as necessary to provide the platform's services.

You must not copy, modify, reverse engineer, disassemble, decompile, reproduce, resell, mirror, create derivative works of, or attempt to derive the source code of the platform or its services, except with prior written consent.

Violations of these obligations, including attempts to infringe upon the platform's intellectual property, may result in immediate account termination and/or legal action, including claims for damages and injunctive relief.

Copyright Complaints

If you believe material hosted on the platform infringes your copyright, please send a written notice to [email protected] containing:

  • Identification of the work claimed to be infringed;
  • The URL of the allegedly infringing material;
  • Your contact details;
  • A statement that you have a good-faith belief that the use is unauthorised.

We will acknowledge receipt within 72 hours and, where appropriate, remove or disable access to the material in accordance with a notice-and-takedown procedure.

Account Security

You are solely responsible for securing your third-party social media service(s) and the credentials linked to those accounts. While two-factor authentication (2FA) is not mandatory, we highly recommend enabling it to protect your account from unauthorised access through your third-party social media service(s). If your account becomes compromised or accessed by an unauthorised party, you agree to notify us immediately via the designated support channels.

The platform does not store access tokens or maintain continuous access to your third-party social media service(s), except to facilitate login authorisation. Once login is complete, any tokens are discarded.

Your access to the platform will remain active even if you log out of your third-party social media service used for login. To enhance security, we advise logging out of the platform explicitly at the end of your session, especially when using a device that is not exclusively for your personal use.

Paid Services

This section outlines the terms and conditions related to any paid services offered through the platform, including but not limited to job advertisements and premium features.

Please refer to the Third-Party Payment Processing section of our Privacy Policy for more detailed information regarding the collection, protection, storage and management of your payment information.

Payments

Job advertisements on the Platform are offered as a paid service, with applicable fees clearly presented during the ad creation process.

For the purposes of Australian Consumer Law, the "service" provided is restricted to publishing the job advertisement on the Platform for the purchased duration; it does not include any guarantee of responses, ranking, or placement outcomes.

Please note the following important details regarding listing durations, renewals, and our payment policies:

  • Each job advertisement remains active for a maximum of 30 days. Advertisers may renew the listing for an additional 30 days, starting up to 7 days before its expiry, and may repeat this process as often as needed until the position is filled. Once a listing expires, it remains expired unless reactivation is specifically requested and approved at our sole discretion.
  • One job advertisement must represent a single position, or multiple identical positions sharing the same title and description. It is not permissible to advertise different roles or categories within one listing.
  • Payment for job advertisements must be submitted in advance; listings will be published only after successful payment processing.
  • All payments are securely managed through Stripe, our designated third-party payment provider. We shall not be liable for delays, errors, or interruptions in payment processing that are attributable to Stripe or other third-party payment services.
  • By providing payment details, you authorise us to charge the specified amount to your chosen payment method for the requested services.
  • We reserve the right to revise our pricing model at any time, at our sole discretion. Any pricing adjustments will be communicated in advance and will apply solely to new purchases made thereafter.
  • All fees are quoted in Australian Dollars. If you choose to remit a payment in an alternative currency, you are responsible for any currency conversion costs or other fees as assessed by your payment provider.
  • We reserve the right to verify and validate payment information before processing. Submitting false, erroneous, or unauthorised payment data constitutes a material breach of these Terms and may result in immediate termination of Services without notice.

Free Promotional Credits

We may, at our sole discretion, offer promotional credits for use on the platform. Free Credits are subject to the following conditions:

  • Free Credits possess no cash value and cannot be redeemed, exchanged, or converted to monetary compensation under any circumstances.
  • Any usage restrictions applicable to Free Credits shall be communicated at the time of issuance and shall be considered binding upon acceptance.
  • Free Credits are non-transferable and may not be sold, shared, transferred, or otherwise assigned to another account or user.
  • We reserve the right to revoke, modify, or cancel Free Credits without prior notice if we determine, at our sole discretion, that said credits were obtained or utilised fraudulently, in error, or in violation of these Terms.
  • When making a purchase, you shall have the option to apply available Free Credits or utilise your preferred payment method. These payment options cannot be combined for a single purchase.
  • Free Credits may or may not have an expiration date, as specified in the terms of the specific promotional offer, and any unused credits shall expire in accordance with such terms.
  • Users are solely responsible for determining and addressing any tax implications that may arise from receiving or using Free Credits in their jurisdiction, and we expressly disclaim any liability for tax consequences resulting from the issuance or use of Free Credits.
  • In the event that Free Credits are revoked or reversed due to error or policy violation, we shall discontinue the associated services without charging your payment method.
  • Free Credits offered through promotional partnerships or third-party platforms may be subject to additional terms imposed by those third parties. We hereby disclaim responsibility for any issues arising from such third-party terms.
  • We shall not be liable for any inability to use Free Credits due to system downtime, technical issues, scheduled maintenance, or any other circumstances beyond our reasonable control.

Any disputes regarding Free Credits must be submitted in writing within thirty (30) days of the disputed transaction or credit allocation. We retain sole and absolute discretion in resolving any disputes related to Free Credits, and all such determinations shall be final and binding.

We reserve the right to introduce, modify, or discontinue Free Credits at any time and for any reason without prior notice. The availability of Free Credits does not establish any ongoing obligation or commitment to provide such credits in the future. By accepting and using Free Credits, you hereby agree to be bound by these terms and any additional terms presented at the time the Free Credits are offered.

Local Taxes and Eligibility

For users located in Australia, we are required by law to collect the Goods & Services Tax (GST) on job advertisements or any other paid services. Prices may be advertised either inclusive or exclusive of GST. Where prices are displayed exclusive of GST, this will be clearly indicated with notations such as "+ GST" or similar. All applicable taxes shall be outlined separately on your invoice or receipt.

Where a price is advertised exclusive of GST, the GST-inclusive total will be displayed prior to final checkout so that the full amount payable is clear before you commit to the transaction.

If you are a sole trader or organisation in Australia and registered for GST, you may be eligible to claim the GST component as an input tax credit. We recommend consulting with your tax advisor or the Australian Taxation Office for guidance on GST claims and reporting. We expressly disclaim any liability for advice regarding tax matters.

For users located outside of Australia, you acknowledge and agree that you shall be solely responsible for determining and remitting any applicable value-added tax, sales tax, or similar consumption-based taxes that may be levied by your local tax authorities in connection with your purchase of our services.

We shall provide tax invoices and receipts in accordance with applicable Australian taxation laws. You are responsible for providing accurate billing and tax information, including your legal name, address, and any applicable tax identification numbers. Failure to provide accurate tax information may result in incorrect tax treatment of your purchases and may constitute a violation of these Terms.

We reserve the right to withhold services or terminate accounts where we determine, in our sole discretion, that inaccurate tax information has been provided or where we have reason to believe that the user is attempting to evade applicable tax obligations.

Payment Processing and Fraud Prevention

As part of our payment processing operations, Stripe, our designated third-party payment processor, conducts independent risk analysis and fraud assessment procedures based on the data provided during the checkout process. These assessment protocols are implemented to ensure the security and integrity of payment transactions. Stripe's evaluation methodology may result in the declination of a payment transaction if it is flagged as potentially fraudulent or determined to pose unacceptable risk according to their internal policies.

In the event of payment declination, we shall, in conjunction with Stripe, endeavor to assist you in resolving any payment-related issues in a timely manner. Notwithstanding such assistance, you acknowledge and agree that it remains your sole responsibility to ensure that all payment details provided are accurate, current, and in full compliance with Stripe's requirements and applicable laws. Failure to provide accurate payment information may result in service disruptions for which we shall bear no liability.

You hereby acknowledge that we may share payment and transaction data with Stripe and other relevant financial institutions as necessary for fraud detection, prevention, and resolution purposes. Such data sharing shall be conducted in accordance with our Privacy Policy and applicable data protection regulations.

We reserve the right to implement additional fraud prevention measures at our sole discretion, which may include, but are not limited to, identity verification procedures, transaction limits, or temporary holds on suspect transactions. You agree to cooperate with any reasonable requests for additional information or verification that may be required as part of these security measures.

We expressly disclaim any and all liability for losses, damages, or inconveniences arising from legitimate fraud prevention measures, including payment declinations, delays in processing, or requests for additional verification. By using our payment services, you acknowledge the necessity of such measures and consent to their implementation.

Company Verification

To maintain listing quality, we conduct automated verification of company details at the time of purchase. This verification process is designed to confirm the validity of the provided information and to ensure that the user publishing the job advertisement is legitimately representing the hiring entity, at our discretion.

If our automated process cannot sufficiently validate the provided information, the advertisement will be placed in a pending state. We will make reasonable endeavours to complete manual verification within one (1) Australian business day of payment and will notify you of the outcome in your dashboard.

Please note that the advertisement period (and any purchased visibility timeframe) commences when the listing is first made publicly viewable, not at the time of payment.

Refunds

In accordance with the Australian Consumer Law and other applicable consumer protection laws, you may be entitled to a refund or other remedy when our services fail to meet a consumer guarantee. Subject to these statutory rights, refunds for paid services may also be granted under the following circumstances:

  • A verified technical issue directly attributable to our platform that substantially prevents the paid service from being delivered as described in the service offering;
  • A paid service, such as a job advertisement, that is removed prematurely due to a demonstrable error in our enforcement of these Terms, as determined by our internal review; or
  • Discontinuation of the platform, whereupon pro-rated refunds for active paid services may be offered.

Notwithstanding any other provision herein, and subject to your rights under the Australian Consumer Law, refunds may not be available for:

  • Lack of user engagement, insufficient responses to job advertisements, or dissatisfaction with the quality or quantity of responses received;
  • Removal of services due to user violations of these Terms or applicable laws;
  • Changes to user requirements or preferences after service purchase;
  • Failure to utilise purchased services within the specified service period; or
  • Issues arising from user error or failure to follow provided instructions.

All refund requests should be submitted in writing to our customer support team within fourteen (14) calendar days of the initial payment date. Each request should include (i) a detailed explanation of the circumstances, (ii) relevant transaction information, and (iii) any supporting documentation that may substantiate the claim.

We will process approved refunds within seven (7) business days of approval. Refunds will be issued using the same payment method utilised for the original transaction, unless technically infeasible, in which case an alternative refund method may be arranged in consultation with you. While we will process refunds promptly, please be advised that the actual receipt of funds may be subject to additional processing times imposed by payment providers, card issuers, or financial institutions that are outside our direct control. We will provide confirmation once we have processed the refund on our end.

For refunds related to services that fail to meet consumer guarantees under the Australian Consumer Law, the applicable statutory remedies will be provided regardless of our standard refund policies. This may include a full or partial refund, depending on the nature and extent of the failure.

Consumer Rights and Guarantees

Nothing in these Terms of Service excludes, restricts, or purports to modify any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law which cannot be lawfully excluded or limited.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures (as defined in section 260 of the Australian Consumer Law) with the service, you are entitled to:

  • A refund for the job listing; or
  • Compensation for the reduced value of the service.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to obtain a refund.

Where the failure does not amount to a major failure, and to the extent permitted by section 64A of the Competition and Consumer Act 2010 (Cth), our liability is limited, at our option, to either (a) supplying the services again; or (b) paying the cost of having the services supplied again.

Where the Australian Consumer Law applies, and to the extent that our Services are supplied to you for personal, domestic, or household use or consumption, all express discretionary elements of our refund and dispute resolution policies operate subject to your statutory consumer rights.

If you wish to pursue a claim under the Australian Consumer Law, the dispute resolution processes outlined in these Terms do not prevent you from pursuing your statutory rights.

Payment Disputes

In the event of any payment dispute, claim, or discrepancy relating to charges for our services, you expressly agree to contact our customer support team directly and attempt to resolve such dispute in good faith prior to initiating any chargeback, reversal, or dispute through your payment provider, credit card issuer, financial institution, or any other third-party payment intermediary.

You acknowledge and agree that:

  • We shall make reasonable efforts to collaborate with you, Stripe (or the appropriate payment processor), and relevant financial institutions to investigate and resolve payment disputes in a timely manner, provided you have first contacted us directly;
  • Initiating a chargeback, reversal, or payment dispute without first notifying us and allowing a reasonable period of not less than fifteen (15) business days to investigate and address your concerns may result in immediate suspension or termination of your account, restriction of access to services, and/or the imposition of additional fees to cover administrative costs associated with dispute resolution;
  • In cases where a chargeback or payment reversal is initiated and subsequently found to be unwarranted or resolved in our favor, you shall be responsible for reimbursing any fees, penalties, or charges imposed on us by payment processors, financial institutions, or other third parties as a direct result of such dispute;
  • We reserve the right to contest any chargeback or payment reversal that we, in our sole discretion, believe to be improper, unwarranted, or initiated in bad faith;
  • Repeated initiation of unwarranted chargebacks or payment disputes may be considered abuse of our payment system and may result in permanent termination of your account and prohibition from using our services in the future;
  • Any outstanding disputed amounts that are ultimately determined to be valid charges shall remain due and payable regardless of the status of your account; and
  • If a chargeback or payment reversal is resolved in our favour, you authorise us to automatically debit (or invoice you for) the disputed amount, any processor penalties and our reasonable recovery costs.

All payment dispute communications must include your account information, the specific transaction details, and a clear explanation of the issue. We will acknowledge receipt of your payment dispute communication within five (5) business days and provide an estimated timeline for resolution.

Nothing in this section shall limit or waive any legal rights you may have under applicable consumer protection laws or regulations regarding billing errors or unauthorised charges. However, you agree to pursue such rights first through our dispute resolution process before resorting to external remedies.

Continued Access to Data

Upon the expiration of a job advertisement, such advertisement shall remain visible to the advertiser within their designated control panel or account dashboard but shall no longer be accessible to the general public or searchable through our platform. Applicants who have previously interacted with or applied to such job advertisements may retain limited access to view basic details of expired job advertisements solely for historical reference purposes, but shall be prohibited from submitting new applications, modifying existing applications, or otherwise interacting with the expired job advertisement.

In accordance with our data retention policies and commitment to user privacy, we expressly reserve the right, at our sole discretion, to remove, delete, or anonymise any and all data associated with expired job advertisements after a retention period of ninety (90) calendar days following the expiration date, unless otherwise required by applicable law or legitimate business purposes. Such data may include, but is not limited to, submitted resumes, cover letters, applicant tracking information, communication logs, application documents, and other user-submitted content related to job applications.

Advertisers are hereby notified and acknowledge that they bear sole responsibility for downloading, exporting, or otherwise securely storing any application data, correspondence, or other materials they wish to retain beyond the aforementioned retention period. We shall not be liable for any loss of data or consequences arising from an advertiser's failure to preserve such information prior to its scheduled removal from our systems.

Notwithstanding the foregoing, we may, in certain circumstances and at our sole discretion, extend the data retention period or provide additional data export options upon written request from an advertiser, provided such request is (i) submitted at least fourteen (14) calendar days prior to the scheduled data deletion date, (ii) complies with applicable data protection and privacy laws, and (iii) does not impose undue technical or operational burdens on our systems.

For clarity, any data retention or removal actions taken pursuant to this section shall be carried out in a manner consistent with our Privacy Policy and applicable data protection laws, including but not limited to any data subject rights regarding erasure, access, or portability that may supersede these provisions where legally mandated.

Search Results and Visibility Disclaimer

The platform employs proprietary automated systems to dynamically display job advertisements based on various factors intended to tailor results to user preferences and search criteria. By using our search functionality, you acknowledge and agree to the following conditions:

  • Our job advertisements are ranked using a complex algorithm considering factors such as keywords, user preferences, geographic proximity, and other dynamic elements. These criteria vary for each search with no guarantee of consistent positioning.
  • Search results will vary over time even when using identical search terms due to continuous updates in our database, advertiser modifications, and algorithmic adjustments.
  • We do not guarantee that all relevant job advertisements will appear in any given search results. Relevant listings may be excluded due to algorithmic decisions, system limitations, or other factors.
  • Advertisers may opt to enhance the visibility of their job advertisements through premium placement options. Such featured listings will be identified as such and may receive preferential positioning within search results.
  • While we provide filtering and sorting capabilities to refine searches, we make no representations regarding the accuracy, reliability, or completeness of filtered results. Filter functionality is provided on an "as is" basis.
  • The visibility of job advertisements may be affected by various technical factors including server performance, network conditions, caching mechanisms, browser compatibility issues, or maintenance activities. We do not guarantee uninterrupted or error-free operation of search functionality.
  • You acknowledge that we owe no fiduciary duty, duty of care or implied covenant of good faith to maintain, rank, boost or continue to display any particular listing, and that algorithmic or manual changes may affect visibility without compensation.

The inherently dynamic nature of our search system intentionally prioritises relevance and user experience over predictability or consistency of results. This approach fundamentally precludes our ability to provide guaranteed placement or visibility for any specific listing. We reserve the right to modify, update, or completely redesign our search algorithms, ranking criteria, and results display methodologies at any time without prior notice.

By using the platform's search functionality, you expressly acknowledge these limitations and agree that any decisions made based on search results are made at your sole discretion and risk. Neither we nor our affiliates shall be liable for any losses, damages, or missed opportunities arising from or related to search results, their accuracy, completeness, or the manner in which they are presented.

Third-Party Listings Disclaimer

Some job advertisements displayed on the platform are imported from publicly available third-party sources. We publish these listings "as received" at the time of import and do not continuously monitor them for subsequent changes. Accordingly:

  • Listing details can become inaccurate or outdated if the source is edited or removed before the advertised expiry date.
  • When a user selects Apply, we run a real-time check and will notify the user if the job is no longer available before redirecting.
  • To comply with our formatting standards we automatically standardise certain data fields—for example remuneration ranges, salary type (hourly/annual), and working-arrangement tags (remote, hybrid, on-site). This process relies on the information provided in the original listing; if that data is missing, incorrectly specified, or in an unexpected format our system may display or categorise it inaccurately.
  • Users and rights-holders may report an issue or request removal using the "Report this job" feature available on each job listing page; where practicable we will re-import, correct or disable the listing promptly.

We do not guarantee the accuracy, currency or continued availability of any third-party listing (including automatically standardised data) and disclaim all liability arising from reliance on such content. We may, at our sole discretion, introduce more frequent validation or additional quality-control measures in the future, but are not obliged to do so.

Job Seeker Disclaimer and Responsibilities

The platform is a venue for displaying job advertisements only. By using Xprt Jobs you acknowledge and agree that:

  • 0x234 Pty Ltd does not guarantee that you will receive an interview, offer of employment, or any response from an Advertiser.
  • We do not undertake background checks on Advertisers or validate the accuracy of every listing. You must conduct your own due-diligence before disclosing personal information, attending interviews or accepting any offer.
  • Any employment contract or arrangement is strictly between you and the Advertiser; 0x234 Pty Ltd is not a party, agent, joint-employer or guarantor of such arrangements.
  • You are solely responsible for assessing the suitability, legality and safety of a role, the employer, workplace conditions, remuneration and any visa or licensing requirements.
  • We are not liable for any loss, cost or damage you suffer arising from (i) the content or accuracy of a job advertisement, (ii) actions or omissions of an Advertiser, or (iii) decisions you make in reliance on information obtained via the platform.
  • When you submit applications through the platform, including personal information, resumes, cover letters, and other attachments, you understand and agree that:
    • Your application data is stored by us in accordance with our privacy policy and shared with the Advertiser of the position.
    • While we store and transmit your data securely, we cannot control or guarantee how Advertisers handle your information once received.
    • You are responsible for reviewing each Advertiser's privacy practices before sharing sensitive personal information.
    • You should only include information in your application materials that you are comfortable sharing with the Advertiser.

Job Advertisement Performance Disclaimer

Our platform provides a venue for employers to post job listings and for job seekers to view these listings. When purchasing a job advertisement, you are paying solely for the placement of your job listing on our platform for the specified duration, not for any particular outcome from that listing.

We expressly do not guarantee, represent, or warrant:

  • Any specific number of views, impressions, clicks, or interactions with your job advertisement;
  • Any particular ranking or visibility in search results beyond what is explicitly offered in any premium placement options;
  • Any specific quantity or quality of applicants or applications;
  • The successful filling of the advertised position;
  • Any particular level of user engagement with your advertisement;
  • The suitability of any applicants who may respond to your advertisement.

For clarity, within the context of the Australian Consumer Law and our Consumer Rights and Guarantees section, a "major failure" in our job advertisement service would constitute only:

  • A complete technical inability to display your properly submitted job listing on our platform;
  • A substantial failure of our platform to make your job listing discoverable through any search or browsing function (where the listing should otherwise be discoverable);
  • A significant alteration or corruption of your job listing content that materially changes its meaning or substance.

Performance metrics such as view counts, click-through rates, or application numbers are expressly not guaranteed and variations in these metrics do not constitute a failure (major or minor) of our service.

By purchasing a job advertisement, you acknowledge and accept these limitations and agree that our service consists solely of providing the technical platform for job listings to be displayed for the purchased duration.

Advertiser Responsibilities

Advertisers using the platform must adhere to the following responsibilities to ensure fairness, transparency, and compliance with the platform's policies and applicable laws. These obligations are designed to maintain the integrity of the platform and provide a positive experience for all users.

Genuine Job Advertisements

All job advertisements must represent genuine and active hiring opportunities. Each ad should provide accurate and complete details, including:

  • The job title and required skills.
  • The location and work arrangement (e.g. remote, hybrid, on-site).
  • The salary or remuneration range.

Job advertisements must comply with all applicable laws and regulations in the location(s) where the job is offered, including anti-discrimination and employment laws.

Restrictions on Modifications

Job advertisements may only be modified within 48 hours of publishing or until the first application is received, whichever comes first. This rule ensures fairness by preventing frequent changes to ad content and maintaining consistency for viewers and applicants.

Prohibition on Applicant-Data Misuse

Advertisers must not use job seekers' Personal Data for purposes unrelated to the job application in which the information was originally provided. Any use of job seekers' data must be strictly limited to evaluating their suitability for the specific job opportunity they applied for. Sharing or retaining applicant data for speculative hiring or any other unauthorised purposes is strictly prohibited.

Additionally, posting job advertisements solely to collect resumes, contact details, or other applicant data without actively hiring for the position — commonly referred to as resume-farming — is strictly prohibited.

  • Applicant data may only be used to evaluate candidates for the specific advertised position.
  • Retaining or reusing applicant data for speculative purposes is not allowed without explicit consent from the applicant.

Advertising Management

Job advertisements must be updated or removed promptly when the position is no longer available. Ads cannot be reused to advertise different positions; a new paid listing is required for each distinct job opportunity.

Reporting and Review of Job Ads

Users have the right to report job ads they believe to be fraudulent, misleading, or in violation of these Terms of Service. Reports will be reviewed by our team, and we will work with the advertiser to address any issues raised. While we may reach out to the reporting user for additional information, we do not guarantee individual responses or resolution updates. We reserve the right to remove or suspend job ads at our sole discretion if they are found to breach these Terms of Service.

Data Privacy and Compliance

Advertisers must manage applicant data in compliance with the platform's Privacy Policy and applicable privacy laws. This includes:

  • Storing applicant data securely and preventing unauthorised access.
  • Using applicant data only for purposes explicitly stated in the job advertisement.
  • Ensuring applicant data is not shared with unauthorised third parties.
  • Accepting the role of data controller for all applicant data transmitted through the platform, including the responsibility to comply with applicable privacy legislation.
  • Acknowledging that 0x234 Pty Ltd functions only as a technical intermediary and bears no liability for Advertiser misuse or unauthorised disclosure of applicant data.

Consequences of Non-Compliance

Failure to meet these obligations may result in:

  • Immediate removal of the offending job advertisement(s).
  • Suspension or termination of the advertiser's account.
  • Legal action, where applicable, for violations of privacy laws, anti-discrimination laws, or the platform's Terms of Service.

Advertiser Indemnity and Warranty

Advertiser represents and warrants that every job advertisement, logo, link, communication and hiring decision made through the platform:

  • complies with the Fair Work Act 2009 (Cth), anti-discrimination legislation, privacy laws and any applicable industry codes;
  • does not infringe any copyright, trade-mark or other intellectual-property right;
  • is truthful and not misleading or deceptive; and
  • relates to a genuine, presently available role.

The Advertiser must indemnify, defend and hold harmless 0x234 Pty Ltd and its officers, directors, employees and agents against any loss, liability, cost, claim or demand (including reasonable legal fees) arising out of or connected with:

  • the content of an advertisement or subsequent recruitment process;
  • any allegation that 0x234 Pty Ltd is an employer, joint-employer or recruitment agent of the applicant; or
  • the Advertiser's breach of the warranties above.

No Agency or Employment Relationship

0x234 Pty Ltd provides an online publishing service only. Nothing in these Terms creates, and you agree that you will not represent that there exists, any partnership, joint venture, fiduciary relationship, labour-hire arrangement, recruitment agency relationship or employer-employee relationship between 0x234 Pty Ltd and any Advertiser, Employer, Recruiter or Job Seeker.

Accessibility and Inclusion

We are committed to ensuring that the platform is accessible to a diverse audience, including individuals with disabilities. While the platform may not currently offer comprehensive accessibility features, we are actively working to improve inclusivity as the platform evolves.

Our goal is to meet recognised accessibility standards over time, making the platform usable and accessible for all. We welcome feedback from users about any accessibility challenges they encounter, and we will consider this feedback in future updates to the platform.

If you have specific accessibility needs or suggestions, please contact us and we will do our best to accommodate your requirements and prioritise accessibility improvements.

Termination

You may terminate this agreement at any time by closing your account and ceasing all access to the platform.

We reserve the right to terminate your account if you violate these terms or engage in activities that compromise the platform's integrity, security, or compliance with applicable laws.

Account termination can be initiated:

  • By the account owner directly within the platform (if available).
  • By contacting us via the registered email address with the details outlined in this document.

To protect against wrongful or unauthorised termination requests, we may request additional identification to verify ownership of the account and associated Personal Data.

Upon termination, your access to the platform will be revoked, and any remaining obligations under these terms (such as compliance with applicable laws) will continue to apply.

Refusal of Service

We reserve the right, at our sole discretion, to refuse service to any user, terminate accounts owned by the user, and, if applicable, block devices associated with the user. Grounds for refusal of service may include, but are not limited to, violations of these terms, unlawful activities, or actions that compromise the security, integrity, or functionality of the platform.

This right extends to denying access to the platform, its features, or any future use of our services.

Modifications to the Platform

We are committed to improving the platform and may add, modify, or remove features or functionality at our sole discretion. These changes may impact how you use certain features or the platform as a whole. While we will make reasonable efforts to notify you of significant changes that could affect your use of the platform, we are not obligated to provide such notifications for all changes.

By continuing to use the platform after changes take effect, you agree to be bound by the updated Terms of Service. If a modification materially reduces the functionality of a feature you have paid for, you may be eligible for a partial refund or credit at our discretion.

Discontinuation of the Platform

We reserve the right, at our discretion, to discontinue the platform and cease further operations. In such an event, we will provide no less than 30 days' prior notice. This notice will be communicated through the platform and/or other reasonable means, such as email.

For active paid job ads at the time of discontinuation, refunds will be calculated based on the portion of the service that was not rendered. Refunds may be issued as a flat rate or based on the remaining duration of the agreed ad visibility period, if applicable, at our discretion. Unpaid job ads will not be refunded and may be removed upon discontinuation of the platform.

Upon discontinuation, we will handle user data in accordance with our Privacy Policy and applicable legal requirements.

Force Majeure

We are not liable for any delay or failure to perform our obligations where the delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, epidemics, strikes, riots, acts of war, terrorism, government action, failure of telecommunications or internet services, power outages, or third-party hosting failures.

Data Loss

We are not responsible for any data that is lost, corrupted, or rendered unreadable under any circumstances, including but not limited to:

  • Communication or transmission errors, or related failures.
  • Equipment malfunctions, including silent hardware corruption or related issues.
  • Failures in backing up or securing data, or the loss or damage of backup media or facilities.
  • Failure to synchronise data with the platform servers, including neglect to log in to ensure data is saved.

Security and Malware Disclaimer

We do not warrant that the platform, or any content available for download from it, is free from viruses, malware or other harmful components. You are responsible for implementing sufficient anti-virus protections and procedures to satisfy your particular requirements for data security.

Indemnification

You agree to indemnify, defend, and hold us, along with our affiliates, officers, directors, employees, and agents, harmless from and against any and all demands, losses, liabilities, claims, or expenses (including reasonable legal fees) made by any third party arising out of or in connection with your use of the platform. This includes, but is not limited to:

  • Breach of any obligation, representation, or warranty under these terms.
  • Misuse of any feature, functionality, or system within the platform.
  • Infringement of intellectual property, proprietary rights, or personal rights of any third party.

You acknowledge that it is your sole responsibility to use the platform accurately, adhere to its community guidelines, respect the rights of others, and comply with all applicable laws. We are not liable for any consequences, financial or otherwise, arising from your misuse of the platform, disputes with other users, or interactions with third parties.

Representations and Warranties

The platform is provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Specifically, we make no representations or warranties that:

  • The platform will meet your specific requirements or expectations.
  • The platform will be uninterrupted, timely, secure, or error-free.
  • The results obtained from using the platform will be accurate, reliable, or suitable for your purposes.
  • The quality of any products, services, information, or other material purchased or obtained through the platform will meet your expectations.
  • Any interactions, engagements, or outcomes facilitated by the platform, including but not limited to communications, responses, or opportunities, will occur as expected.
  • Any errors in the platform will be corrected.
  • Requested enhancements, features, or functionalities will be delivered.

We also disclaim liability for any issues arising from factors outside our control, including, but not limited to, third-party integrations, network interruptions, or unforeseen technical difficulties.

Limitation of Liability

To the maximum extent permitted by law and without limiting any non-excludable rights under the Australian Consumer Law (ACL), we are not liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including loss of profits, revenue, data or opportunity, even if advised of the possibility of such loss.

Where liability cannot be excluded but can be limited, our aggregate liability arising out of or relating to the platform is limited to the total fees you paid us for the relevant service in the twelve (12) months preceding the event giving rise to the claim.

Unlawful Activities

The use of the platform for unlawful activities, harassment of other users, or the distribution of harmful, offensive, or inappropriate content is strictly prohibited. By using the platform, you agree not to engage in any such activities.

We reserve the right to suspend or terminate your account immediately if we suspect any activities that are unlawful, harassing, harmful, or inappropriate. Such actions may also result in legal consequences. Additionally, we reserve the right to report any suspected unlawful activities to the appropriate law enforcement authorities and cooperate fully with their investigations.

Governing Law and Dispute Resolution

These terms, and all matters relating to your access to or use of the platform, including disputes, are governed by the laws of South Australia, Australia.

Before initiating any arbitration or court proceedings (except where urgent injunctive relief is sought), the following dispute resolution steps must be undertaken:

  1. Notification: The party raising the dispute must notify the other party in writing, detailing the nature of the dispute and providing sufficient information to allow for consideration and response.
  2. Discussion: Both parties must engage in discussions or correspondence in good faith to attempt to resolve the dispute.
  3. Arbitration: If the dispute remains unresolved 30 days after the initial notification, the dispute must be referred to arbitration in accordance with the Institute of Arbitrators and Mediators Australia Fast Track Arbitration Rules. The decision of the arbitrator will be final and binding on both parties, except as required by law.

Any litigation connected with these Terms or the platform must be commenced exclusively in the courts of South Australia, and each party irrevocably submits to that venue and waives any objection based on forum non conveniens.

Severability

If any provision of these Terms of Service is found to be unlawful, invalid, or otherwise unenforceable, that provision will be severed from these terms, and the remaining provisions will continue in full force and effect as if the unenforceable provision had not been included.

In the event that two or more provisions are found to conflict with each other, we reserve the right to determine which provision will remain in effect.

Survival

Sections relating to Intellectual Property, Indemnification, Advertiser Indemnity and Warranty, Limitation of Liability, Governing Law and Dispute Resolution, Survival and Entire Agreement survive termination or expiry of these Terms for any reason.

Entire Agreement

These Terms of Service, together with any documents expressly incorporated by reference, constitute the entire agreement between you and 0x234 Pty Ltd regarding the platform and supersede all prior or contemporaneous understandings, agreements, negotiations, representations and communications.

Links to Other Websites

The platform may include links to third-party services and websites that are not operated by us. If you click on a third-party link, you will be directed to that third-party site. While we strive to maintain the integrity of the platform, we cannot guarantee the safety of all external links posted by users. We will make a reasonable effort to remove or block any harmful links that are identified, but we cannot assure that all such links will be found or removed before they are accessed.

We have no control over and assume no responsibility for the content, products, or services on or available from those websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party websites or resources.
