Our client is a reputable and thriving law firm dedicated to providing exceptional legal services in the field of commercial law. The team of experienced solicitors are committed to helping clients navigate the complexities of commercial-related legal matters with compassion, expertise, and integrity. They strive to achieve the best possible outcomes for our clients, ensuring their rights and interests are protected throughout the legal process
The successful candidate will:
- Have completed their supervised legal practice period;
- Have 2+ years of experience in commercial law litigation;
- Be able to manage all aspects of commercial law cases from initial consultation to resolution;
- Be confident and proficient in either of the following areas of commercial law:
1. Business law, including the sale and purchase of businesses;
2. Contract law, including drafting and advising on contracts and agreements (including franchising agreements), contractual breaches, negotiating contracts, and debt recovery;
3. Corporate law, including the formation, governance, compliance and dissolution of corporations, mergers and acquisitions, corporate structures, directors' duties, shareholder rights, shareholder/unitholder agreements, and insolvency;
4. Commercial litigation, including disputes in commercial transactions, franchising disputes, breach of contract, debt recovery, shareholder disputes and professional negligence;
5. Civil litigation, including debt recovery enforcement, warrants, statutory demands and bankruptcy proceedings;
6. Real estate law, including drafting and advising on agreements for the purchase, sale and leasing of real property, as well as real estate transactions and negotiating property-related disputes;
7. Commercial leasing, including negotiating and drafting commercial lease agreements for business premises;
8. Intellectual property law, including patents, trademarks and copyrights, as well as licensing and infringement issues and intellectual property rights and disputes (desirable but not required);
9. Arbitration and alternative dispute resolution; and
10.PPSR (Personal Property Securities Register) lodgement and removal.
11. Property, trusts, estate and wills matters
- Be able to represent clients in mediations and negotiations, including by appearing in some court hearings;
- Have excellent organisation skills and attention to detail;
- Have strong negotiation and interpersonal skills;
- Have excellent written and verbal communication skills;
- Be confident when speaking with clients - this includes the ability to turn a prospect into a client/appointment;
- Be self-reliant and independent
